Terms of Service

1. The service
Emailer provides email automation for WooCommerce stores: event capture via our WordPress plugin, automated email flows, managed delivery, and reporting. By creating an account you agree to these terms, our Privacy Policy, and our Anti-Spam Policy, which is a binding part of these terms.
2. Your responsibilities
- Only send permission-based email as defined in the Anti-Spam Policy;
- Provide accurate account and sender information;
- Comply with laws applicable to your business and your recipients (including CAN-SPAM, CASL, GDPR);
- Keep your credentials secure and notify us of any suspected compromise.
3. Plans, billing, and limits
Plans are billed monthly with email-volume limits per tier. Sending pauses when a limit is reached and resumes on upgrade or at the next cycle. You can cancel at any time; service continues until the end of the paid period. We may adjust pricing with at least 30 days' notice.
4. Suspension and termination
We may suspend sending automatically when deliverability thresholds are exceeded (see Anti-Spam Policy) and may terminate accounts for material breach, including any use of purchased or harvested lists. You may delete your account at any time; we will delete your data per the Privacy Policy.
5. Service quality
We work hard to keep the service reliable, but it is provided "as is" without warranties of uninterrupted operation or specific deliverability outcomes. Email delivery ultimately depends on third-party mailbox providers.
6. Liability
To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect or consequential damages.
7. Changes
We may update these terms; material changes will be announced by email or in the dashboard at least 14 days in advance. Continued use after the effective date constitutes acceptance.
