Anti-Spam Policy

1. Permission is required
Merchants using Emailer may only send email to recipients who have a direct relationship with their store:
- Customers who have purchased from the store;
- Shoppers who began a checkout and provided their email address to the store directly;
- Subscribers who explicitly opted in to the store's marketing at checkout or via the store's own forms.
2. Prohibited practices
- Purchased, rented, traded, or scraped email lists — under any circumstances;
- Sending to addresses harvested from websites, directories, or third parties;
- Cold outreach, unsolicited bulk email, or "prospecting" campaigns of any kind;
- Misleading subject lines, forged headers, or disguised sender identities;
- Re-adding recipients who have unsubscribed or been suppressed.
Bulk list imports require an attestation of origin and are unavailable on free accounts.
3. What we enforce automatically
- One-click unsubscribe (RFC 8058) headers and a visible unsubscribe link in every marketing message. Opt-outs are honored immediately — they are evaluated at the moment of every send.
- Suppression: hard bounces and spam complaints suppress the address automatically, within seconds, across the platform.
- Automatic pausing: senders whose complaint rate exceeds strict thresholds (well below industry limits) are paused automatically pending review.
- Consent records: consent state is synced from the merchant's store and recorded immutably with source and timestamp.
4. Compliance with law
Merchants must comply with all applicable law, including CAN-SPAM (US), CASL (Canada), and the GDPR/ePrivacy rules (EU/UK), and must honor regional consent requirements for their recipients. Emailer provides the technical controls; the merchant is responsible for lawful use in their jurisdictions.
5. Reporting abuse
If you believe you received unwanted email sent through Emailer, report it to abuse@where-its-at.app — include the message headers if possible. We investigate every report, suppress affected addresses, and terminate accounts that violate this policy.
6. Enforcement
Violations result in immediate sending suspension and, for willful violations (including any use of purchased lists), account termination without refund. We cooperate with mailbox providers and blocklist operators in abuse investigations.
